Ce texte, adopt\u00e9 pour r\u00e9duire un \u00e9cart salarial entre femmes et hommes \u00e9tabli \u00e0 <strong>11 %<\/strong> par Eurostat, impose aux employeurs une obligation accrue d&rsquo;information sur les salaires pratiqu\u00e9s.<\/p>\n<\/p>\n<h2>Six pays sans aucune mesure, dix avec un projet de loi en cours<\/h2>\n<\/p>\n<p>Selon l&rsquo;outil de suivi du cabinet international <strong>Addleshaw Goddard<\/strong>, six \u00c9tats membres n&rsquo;avaient, en mai 2026, pris <strong>aucune mesure<\/strong> de transposition : l&rsquo;Autriche, la Bulgarie, la Croatie, la Hongrie, le Luxembourg et le Portugal. En septembre 2025, ce chiffre atteignait encore dix pays, illustrant une acc\u00e9l\u00e9ration tardive et insuffisante.<\/p>\n<\/p>\n<p>Dix autres pays ont publi\u00e9 des projets de loi \u00e0 des stades d&rsquo;avancement variables : Chypre, le Danemark, l&rsquo;Estonie, la France, l&rsquo;Irlande, l&rsquo;Italie, la Lettonie, la Lituanie, les Pays-Bas et la Roumanie. La Belgique, Malte et la Pologne affichent une mise en \u0153uvre partielle.<\/p>\n<\/p>\n<p>La <strong>Slovaquie<\/strong> fait figure d&rsquo;exception : son Parlement a approuv\u00e9 la loi sur l&rsquo;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration le 15 avril 2026, avec une entr\u00e9e en vigueur pr\u00e9vue au 7 juin 2026. \u00c0 l&rsquo;inverse, la <strong>Su\u00e8de<\/strong> a suspendu sine die son projet de loi en mars 2026, invoquant la charge administrative impos\u00e9e aux employeurs.<\/p>\n<\/p>\n<h2>France et Allemagne : une incertitude juridique pr\u00e9occupante<\/h2>\n<\/p>\n<p>En France, le non-respect de l&rsquo;\u00e9ch\u00e9ance semble acquis. <strong>J\u00e9r\u00e9mie Paubel<\/strong>, associ\u00e9 en droit social chez Addleshaw Goddard, souligne que \u00ab m\u00eame une fois la loi adopt\u00e9e, des \u00e9l\u00e9ments cl\u00e9s devront encore \u00eatre d\u00e9finis par des d\u00e9crets d&rsquo;application s\u00e9par\u00e9s, sans calendrier pr\u00e9cis \u00bb. Il recommande aux entreprises d&rsquo;agir d\u00e8s maintenant : cartographie des cat\u00e9gories d&#8217;emplois, audit des structures de r\u00e9mun\u00e9ration, identification des \u00e9carts.<\/p>\n<\/p>\n<p>En Allemagne, la situation est structurellement comparable. <strong>Marijke Van der Most<\/strong>, associ\u00e9e en droit social allemand au sein du m\u00eame cabinet, avertit que le retard l\u00e9gislatif \u00ab ouvre une p\u00e9riode transitoire o\u00f9 les entreprises n&rsquo;ont pas encore de r\u00e8gles nationales pr\u00e9cises, alors que les tribunaux, les salari\u00e9s et les comit\u00e9s d&rsquo;entreprise se r\u00e9f\u00e8rent d\u00e9j\u00e0 \u00e0 l&rsquo;orientation fix\u00e9e par la directive \u00bb.<\/p>\n<\/p>\n<p>Berlin devrait actualiser sa l\u00e9gislation en 2026. Des projets de loi sont \u00e9galement attendus en Tch\u00e9quie, Finlande, Gr\u00e8ce, Slov\u00e9nie et Espagne.<\/p>\n<\/p>\n<h2>Transparence dans les offres d&#8217;emploi : le Royaume-Uni en t\u00eate, l&rsquo;Allemagne \u00e0 la tra\u00eene<\/h2>\n<\/p>\n<p>Les donn\u00e9es de la plateforme de recrutement <strong>Indeed<\/strong> permettent de mesurer concr\u00e8tement la progression de la transparence salariale dans les annonces d&#8217;emploi. En mars 2026, le <strong>Royaume-Uni<\/strong> \u2014 hors UE \u2014 affichait le taux le plus \u00e9lev\u00e9 d&rsquo;Europe avec <strong>56 %<\/strong> des offres mentionnant une r\u00e9mun\u00e9ration, en recul toutefois par rapport aux 65 % enregistr\u00e9s en mai 2025.<\/p>\n<\/p>\n<p>Au sein de l&rsquo;UE, les <strong>Pays-Bas<\/strong> (48 %) et la <strong>France<\/strong> (43 %) d\u00e9passent le seuil des 40 %. L&rsquo;Irlande (39 %) et l&rsquo;Italie (36 %) suivent, cette derni\u00e8re ayant sensiblement progress\u00e9 depuis les 23 % de mai 2025. En queue de peloton, l&rsquo;<strong>Espagne<\/strong> (17 %) et l&rsquo;<strong>Allemagne<\/strong> (12 %) restent tr\u00e8s en retrait.<\/p>\n<\/p>\n<h2>Un co\u00fbt chiffr\u00e9 pour les travailleuses europ\u00e9ennes<\/h2>\n<\/p>\n<p>La <strong>Conf\u00e9d\u00e9ration europ\u00e9enne des syndicats (CES)<\/strong> estime que l&rsquo;absence de mise en \u0153uvre de la transparence salariale co\u00fbte aux femmes entre <strong>4,8 et 7,2 milliards d&rsquo;euros par an<\/strong> \u00e0 l&rsquo;\u00e9chelle de l&rsquo;UE, soit entre 465 et 700 euros par femme et par an.<\/p>\n<\/p>\n<p><strong>Lisa Feist<\/strong>, \u00e9conomiste du march\u00e9 du travail de l&rsquo;UE chez Indeed Hiring Lab, r\u00e9sume l&rsquo;enjeu : \u00ab La r\u00e9mun\u00e9ration est le premier facteur qui pousse les gens \u00e0 chercher un nouveau travail. Pourtant, en Europe, c&rsquo;est l&rsquo;information que la plupart des offres d&#8217;emploi omettent. \u00bb Elle note n\u00e9anmoins que les employeurs qui anticipent la transparence peuvent en tirer un avantage concurrentiel en mati\u00e8re de recrutement.<\/p>\n<\/p>\n<h2>Des sanctions europ\u00e9ennes en perspective<\/h2>\n<\/p>\n<p>Les \u00c9tats membres qui ne transposeront pas la directive dans les d\u00e9lais s&rsquo;exposent \u00e0 des proc\u00e9dures d&rsquo;infraction initi\u00e9es par la Commission europ\u00e9enne.
